Terms of Service
Last Updated: September 25, 2026These Terms of Service constitute a legally binding agreement made between you and Wothus LLC, doing business as AiroGram ("we," "us," or "our"). By registering for an account or using AiroGram ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our Service.
1. Description of Service
AiroGram provides a business-to-business (B2B) software-as-a-service platform for cold email outreach, sender rotation, unibox management, and lead engagement. The Service is intended strictly for your internal business use to manage direct B2B sales and marketing activities.
2. Account Security & Workspaces
- Isolated Workspaces: Each user account constitutes an isolated workspace. You are entirely responsible for maintaining the confidentiality of your login credentials.
- Connected Accounts: To use AiroGram, you must integrate third-party email accounts. You represent that you have the right to grant AiroGram access to these accounts to facilitate email sending and routing.
3. Acceptable Use & Anti-Spam Compliance
You are solely responsible for all content, emails, and campaigns sent through your AiroGram workspace. You strictly agree to:
- Comply with all applicable anti-spam laws, including the CAN-SPAM Act, GDPR, and similar international regulations.
- Provide accurate sender identification and valid physical postal addresses in your communications.
- Never use AiroGram for any Data Resale Activity (selling, licensing, or commercializing data obtained from our platform).
- Never use the Service to send explicit, illegal, deceptive, or malicious content.
4. Payments, Renewals & Refunds
Subscriptions & Renewals: Paid plans are billed in advance on a recurring basis (monthly or annually). Your subscription will automatically renew unless canceled prior to the end of the current billing cycle.
Billing and Payments: All payments and subscription fees are processed by our parent company. Charges on your credit card or bank statement will appear as Wothus LLC.
No Refunds: All fees paid to AiroGram are strictly non-refundable and non-cancellable. We do not provide prorated refunds for unused time or partial months.
5. AI Tools & Third-Party Data
AiroGram may include Artificial Intelligence (AI) generation tools and lead enrichment features powered by third-party services. Outputs generated by AI tools are provided "as-is." You are solely responsible for reviewing AI-generated content before sending and ensuring it does not infringe on third-party rights or violate applicable laws.
6. Data Ownership & Licensing
You retain ownership of the leads and content you upload to AiroGram (Subscriber Data). You grant AiroGram a non-exclusive license to process this data solely to provide the Service, and to use de-identified, aggregated data to improve our platform's deliverability and performance metrics.
7. Termination & Suspension
AiroGram reserves the right to immediately suspend or permanently terminate your account without notice or refund if you violate these Terms (including engaging in spam, illegal activities, or circumvention of our technical limits).
8. Disclaimer of Warranties & Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WOTHUS LLC (DBA AIROGRAM) MAKES NO GUARANTEES REGARDING EMAIL DELIVERABILITY, INBOX PLACEMENT, OR MINIMUM UPTIME. IN NO EVENT SHALL WOTHUS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO AIROGRAM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Governing Law
These Terms shall be governed by and defined following the laws of the State in the United States where Wothus LLC is registered, without regard to its conflict of law principles. AiroGram and yourself irrevocably consent that the courts of that specific State shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
